1. Acceptance of Terms

By downloading, installing, or using Fade: Duel Arena ("Fade," "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. Fade is operated by Checkmate Labs, LLC ("we," "us," or "our").

2. Description of Service

Fade is an entertainment-only mobile game in which players control virtual knights that engage in player-versus-player (PvP) and player-versus-environment (PvE) duels using a virtual currency system. The game includes stat allocation, virtual item customization, leaderboard rankings, a daily Boss Gauntlet, and an Endless Gauntlet ("The Depths") mode where players pay a virtual entry fee and fight escalating opponents for increasing virtual rewards.

3. Virtual Currency and Items

3.1 No Real-Money Value

All "gold," "wagers," "rewards," and virtual items within Fade are entirely virtual and exist solely within the game. They have no real-world monetary value whatsoever.

3.2 No Purchase, Exchange, or Redemption

Virtual currency and virtual items in Fade:

Cannot be purchased with real money
Cannot be sold, exchanged, or traded for real money
Cannot be redeemed for real-world goods, services, or currency
Cannot be transferred between users outside the game
Cannot be cashed out or withdrawn in any form

3.3 Not Gambling

Fade is not a gambling application. The game's wager system, including PvP duel wagers, Boss Gauntlet bets, and Endless Gauntlet entry fees, uses virtual currency with no real-world value. No real money is staked, wagered, won, or lost at any point during gameplay. The virtual currency system is a game mechanic for entertainment and competitive engagement only. Fade is a skill-based strategy game where outcomes are determined by player decisions (stat allocation) and game mechanics, not by chance alone.

3.4 No Monetary Consideration

Because virtual gold cannot be purchased or cashed out, there is no monetary consideration involved in any aspect of gameplay. Users do not risk anything of real-world value when participating in duels.

4. User Accounts

4.1 Anonymous Accounts

Accounts are created anonymously. Each user receives a randomly generated medieval word-pair username and a unique invite code. No personal information is required to create or maintain an account.

4.2 Account Security

You are responsible for maintaining the confidentiality of your four-digit PIN. We are not liable for unauthorized access to your account resulting from your failure to safeguard your PIN.

4.3 Account Deletion

You may delete your account at any time through the Settings menu. Account deletion is permanent and irreversible. All associated data, including virtual currency, virtual items, and statistics, will be permanently destroyed.

5. Acceptable Use

You agree not to:

Attempt to sell, trade, or exchange virtual currency or items for real money or real-world goods
Use the App for any form of real-money gambling or wagering
Exploit bugs, glitches, or vulnerabilities to gain unfair advantages
Harass, threaten, or abuse other players
Use automated scripts, bots, or tools to interact with the App
Attempt to reverse-engineer, decompile, or modify the App
Impersonate other players or Checkmate Labs staff

6. Reporting and Moderation

You may report inappropriate behavior through the in-app reporting feature. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

7. Intellectual Property

All content within Fade, including but not limited to graphics, code, text, game mechanics, and design, is the property of Checkmate Labs, LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial entertainment purposes only.

8. Disclaimer of Warranties

Fade is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Your use of the App is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, Checkmate Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of virtual currency, virtual items, or game progress, arising from your use of the App.

10. Age Requirement

Fade is intended for users aged 12 and older. By using the App, you represent that you are at least 12 years of age, or that you have parental or guardian consent to use the App.

11. Modifications

We reserve the right to modify the App, virtual economy, game mechanics, or these Terms at any time. Material changes to these Terms will be communicated through the App or our website. Continued use of the App after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the App shall be resolved in the courts of Travis County, Texas.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
